The client was working as head chef in a local restaurant. After a number of years in post, the employer reduced his status to chef and informed the Home Office. The client learnt of this change only when the Home Office sent him a letter saying that he was in breach of immigration rules.
The advocate visited the employer and explained what had been done. After speaking to an Immigration Solicitor, he advised the company they had to find immigration solicitor, and have the client’s status resolved. The company were advised to write a letter to admit an error on their part, and that his status had not changed.
The Home Office accepted this, and the company apologised to the client.
The client’s immigration status is now that he has received Indefinite Leave to Remain, and is now applying for Naturalisation.
