The examination of the Minerals Waste Local Plan (MWLP) is now closed.  The Council received the Inspector's final report on the MWLP on 29 June 2017.  This report concludes that, subject to the Main Modifications set out in the report, the MWLP is sound and capable of adoption.

Previous Examination Progess

Cumbria County Council submitted its proposed Minerals and Waste Local Plan to the Planning Inspectorate for examination on 9 September 2016. The submitted documents can be viewed here. The list of all submission and evidence base documents can be found in the Core Document List.

Following closure of the Hearing Sessions on 14 December, the Council have prepared final responses to the minerals, waste and radioactive waste questions and a draft Table of Proposed Modifications to the Local Plan.

Programme Officer

The Programme Officer, Mr Jonathan Evans, will act as the contact for any person who has an interest in the Examination and as a liaison between the Inspector, County Council and Representors.

He is an independent Officer of the Examination and works on behalf of the Inspector to organise and manage the administrative and procedural matters of the Examination process. Mr Jonathan Evans is therefore the appropriate point of contact for any questions relating to timetabling or procedural matters. All statements will also be submitted through him. Any matters that anyone wishes to raise with the Inspector should be submitted via the Programme Officer. He can be contacted as follows:

The Inspector

In accordance with section 20 of the Planning and Compulsory Purchase Act 2004 (as amended), Inspector Elizabeth Ord LLB (Hons) LLM MA DipTUS has been appointed to conduct the examination to determine whether the above-named Local Plan is sound.  The opening of the formal hearing part of the examination into the Local Plan took place on Tuesday 29th November (see below for further details).

The Inspector's task is to consider the soundness of the submitted Plan, based on the criteria set out in paragraph 182 of the National Planning Policy Framework (NPPF).  The relevant soundness criteria are whether the Local Plan is:

  1. Positively prepared - based on a strategy that seeks to meet objectively assessed development and infrastructure requirements, including unmet requirements from neighbouring authorities where it is reasonable to do so and consistent with achieving sustainable development;

  2. Justified - the most appropriate strategy when considered against the reasonable alternatives, based on proportionate evidence;

  3. Effective - the plan should be deliverable over its period and based on effective joint working on cross-boundary strategic priorities; and

  4. Consistent with national policy - the plan should enable the delivery of sustainable development in accordance with the NPPF. 

The Inspector will take into account the representations submitted upon the Local Plan at Pre Submission stages as far as they relate to soundness considerations. A number of informal debates took place on the principal matters identified by the Inspector at the Hearing Sessions.

Following the closure of the Examination Hearing Sessions on 14 December 2016, the Inspector will now prepare a written report to the County Council with precise recommendations. These recommendations may include modifications to the Local Plan, if such a request is made by the County Council.

The Examination Process

 The Local Plan examination is expected to follow the format outlined below:

  • Publication of Matters and Issues - these are the matters and issues that the Inspector has identified to date for consideration at the hearings. The Inspector has now issued the draft Matters and Issues for both non-radioactive waste and radioactive waste 
  • Production of Written Statements - All statements in response to the draft Matters and Issues from  have now been submitted and can be viewed at the bottom of this page in the list of Examination Documents.
  • Hearing Sessions - The Hearing sessions took place on the following dates and at the following venues:

              On 29 and 30 November and 6 and 7 December the Hearing sessions were held at Stricklandgate House, LA9 4PU in Kendal

              On 13 and 14 December the hearing sessions were held at the Washington Hotel  CA14 3AY in Workington

          Hearings are an opportunity for the Inspector to clarify and/or seek additional information on any issues relating to the 'soundness' of the Local Plan.   
          Members of the public were able to attend the hearing sessions to observe proceedings.

  • Production and Issue of the Inspector's Report setting out her recommendations.
